Terms and Conditions of Use

1. Company Identification

This service is operated by Lynx Check-in owned by Ignacio Lopezosa Serrano, with address at Boulevard Louis Pasteur, 47, 29010, Málaga, Málaga, Andalucía, España, and DNI 51142742B.

2. Object of the Contract

These General Terms and Conditions govern the use of Lynx Check-in, a digital platform that provides software-as-a-service (SaaS) for managing mandatory traveler reports to competent authorities, in compliance with Royal Decree 933/2021.

Lynx Check-in acts as a service provider to facilitate compliance with legal obligations, but legal responsibility for submitting traveler reports remains with the accommodation provider ("CLIENT").

3. Definitions

  • CLIENT: The accommodation provider (hotel, hostel, rural house, apartment, etc.) who contracts Lynx Check-in services.
  • GUEST: The traveler who stays at the accommodation and whose data must be reported to authorities.
  • TRAVELER REPORT: The document that must be submitted to competent authorities according to Royal Decree 933/2021.
  • AUTHORITIES: Competent bodies that receive traveler reports (National Police, Guardia Civil, Mossos d'Esquadra, Ertzaintza).

4. Client Obligations

  1. Provide accurate and complete guest data for report generation.
  2. Verify the accuracy of data before authorizing report submission.
  3. Maintain valid credentials for accessing the authorities' systems.
  4. Comply with current data protection regulations (GDPR, LOPDGDD).
  5. Pay fees according to the contracted plan and within established deadlines.

5. Service Conditions

Lynx Check-in provides the following services:

  • Automated generation of traveler reports based on provided data.
  • Submission of reports to competent authorities through official channels.
  • Secure storage of reports for the legally required period (3 years).
  • Management dashboard for tracking report status and history.
  • Technical support during business hours.

Our service is built on robust cloud infrastructure to ensure high availability and security.

6. Pricing and Payment Terms

Lynx Check-in operates under a subscription model with the following rates:

  • Monthly Plan: €29.90 per month per property
  • Annual Plan: €299 per year per property (equivalent to 10 months)
  • Biennial Plan: €499 per two years per property (equivalent to 16.6 months)

Special prices may apply for multiple properties or extended contracts.

Prices may be updated with 30 days' advance notice.

Payment is processed automatically via credit card or bank transfer.

7. Service Guarantees

  • Money-back Guarantee: If you're not satisfied within the first 30 days, we'll refund your payment in full.
  • Anti-fine Guarantee: If a report fails due to our service error, we'll cover any fines imposed by authorities, up to a maximum of €1,000 per incident.

No refunds will be provided for suspensions due to non-compliance with these terms or for services already rendered.

8. Cancellation and Service Termination

Either party may terminate this contract under the following conditions:

  • The CLIENT may cancel at any time with 30 days' notice.
  • Lynx Check-in may terminate service for non-payment after 15 days' notice.
  • Immediate termination may occur in cases of misuse or violation of these terms.
  • Upon termination, data will be retained for the legally required period before secure deletion.

9. Limitation of Liability

Lynx Check-in's liability is limited as follows:

  • We are not liable for damages caused by incorrect data provided by the CLIENT.
  • We do not guarantee uninterrupted service during maintenance or force majeure events.
  • We are not responsible for changes in authority requirements or technical systems.
  • Liability for indirect damages is excluded.
  • Our total liability is limited to the amount paid by the CLIENT in the last 12 months.

Maximum liability is capped at €10,000 per incident.

10. Intellectual Property

All software, trademarks, designs, and content of Lynx Check-in are protected by intellectual property rights. The CLIENT receives a limited license to use the service but may not copy, modify, or distribute our software.

11. Data Protection

  • Lynx Check-in acts as a data processor for CLIENT data and as a data controller for its own business data.
  • The CLIENT remains the data controller for guest information and must ensure proper consent and legal basis for processing.
  • All data is stored in secure servers within the European Union, complying with GDPR requirements.
  • Data subjects can exercise their rights by contacting the CLIENT or Lynx Check-in directly.

12. Modification of Terms

These terms may be modified with 30 days' advance notice. Continued use of the service after notification implies acceptance of the new terms. Major changes will require explicit acceptance.

13. Applicable Law and Jurisdiction

These terms are governed by Spanish law. Any disputes will be resolved in the courts of Madrid, Spain, unless the CLIENT is a consumer, in which case they may choose their local jurisdiction.
